On the following pages, we, Continental Teves AG & Co. oHG, present a photo database allowing free-of-charge downloading and/or the ordering via e-mail of fine data for printing, for which a fee is payable. The use of these pages and of photo and text files obtained from these pages (whether free-of-charge or for a fee) shall be subject to these General Conditions of Use. By using these pages, the user shall be deemed to have accepted these General Conditions of Use without any reservations
2. We reserve the right to amend these General Conditions of Use in whole or in part at our sole discretion. Amendments to these General Conditions of Use shall become effective immediately upon publication. The user undertakes to inform himself regularly of any amendments to these General Conditions of Use.
3. The content of the photo and text files offered on the following pages is presented as it is currently available. Except in cases where warranty obligations are expressly required by compulsory provisions of law, we assume no liability whatsoever for the correctness, scientific quality or completeness of these files or for any typographical errors.
4. Fine data ordered by the user may only be used in accordance with our corporate design directives, which may be accessed via our internet page ("Info" -> "ATE Directives"). In addition, photo and text files made available via these pages shall be used only for the purposes for which they are made available. The user shall not make any modifications to photographs and shall only replace texts by translations into his national language with the same content as the text replaced. As regards the typefaces used, the user shall be obligated to obtain any licences which may be required or to ensure that such licences are available. Any use of data obtained from the database beyond the purposes stated shall be subject to our prior written approval.
5. We shall not be liable for any loss or damage arising from any use of data and information which is not in accordance with the intended purpose. As a matter of principle, we shall be liable under the terms of law only if we have caused damage willfully and knowingly or by gross negligence. Without limitation, we shall not be liable for any damage arising out of or in connection with the use of any content obtained by the use of this internet service or any other use of these services. This shall also apply to any loss or damage cause by defects in or problems with this internet service, viruses or data loss. Furthermore, we assume no warranty whatsoever as to the proper availability of this service at all times or as to the uninterrupted use or availability of this service. Users access this service at their own risk and under their own responsibility. Any risk of loss or damage which may be caused by actions taken by the user within this service, such as the downloading of files, shall be borne by the user himself. We therefore assume no liability whatsoever for any unforeseen events.
6. The user shall not carry out any manipulations on this internet service itself or on any content made available via this internet service. The user shall not take any action which could impair the use of this internet service by other members. The user shall be obligated to keep his login or password confidential and shall be liable to us for any loss or damage incurred by us as a result of authorized or unauthorized use of this internet service or FTP access with his login or password. This shall also apply to their use by third parties. In this connection, we expressly inform the user that it is not possible to prevent third parties from accessing or misusing this internet service or FTP access if the login or password is correctly entered. The user shall be obligated to inform us immediately of any misuse of his login and/or password by third parties and of any risk that his login and/or password may be misused by third parties, for example in the event of the loss of his login or password. We will only be able to block the login or password following notification by the user. Until he has properly given notice of termination of his use of this internet service or his login or password has been withdrawn by us, the user shall remain liable for any and all activities carried out with his login or password. The user shall also be liable for any claims of whatsoever type arising out of or in connection with any activities carried out using his login or password before his use of this internet service is terminated

The user hereby declares that he agrees to the electronic acquisition, storage, use and processing of his data in connection with this internet service subject to the applicable data protection provisions. We will keep the user’s data strictly confidential. Apart from the administration and processing of orders received from the user, we will not process, use or disclose the personal data of the user for promotion or market research purposes or for the design of the internet service without the express permission of the user. However, we shall be entitled to record and process data in an anonymous way which does not allow the identity of the user to be traced. By using this internet service, the user shall be deemed to have agreed to the use of his personal data in the manner stated in this Section 7.
8. In the event that these pages include links to the internet presentations of third parties, such links are only intended as a reference to the availability of further information. We do not review the content of such internet presentations of third parties. Only the respective providers of internet presentations accessed via links shall be liable for the content of such presentations.
9. Any legal relationships created between ourselves and users by these General Conditions of Use shall be governed by the law of the Federal Republic of Germany. The application of the Convention on the International Sale of Goods (CISG) is expressly excluded.
